3 Conditions Applicable
3.1 These Conditions shall apply to all contracts for the sale of Goods by Enimed Ltd (TA MedsNow) to the Buyer to the exclusion of all other terms and conditions including any terms or conditions which the Buyer may purport to apply under any purchase order confirmation of order or similar document. These conditions will prevail over any other information supplied to the Buyer or displayed on our website.
3.2 All orders for Goods shall be deemed to be an offer by the Buyer to purchase Goods pursuant to these conditions.
3.3 The contract for the sale of the Goods shall not be concluded until Enimed Ltd (TA MedsNow) has confirmed the order to the Buyer either by email or phone.
3.4 Acceptance of delivery/collection of the Goods shall be deemed conclusive evidence of the Buyer’s acceptance of these conditions.
3.5 Any variation to these conditions (including any special terms and conditions agreed between the parties) shall be inapplicable unless agreed in writing by Enimed Ltd (TA MedsNow)

4 The Price and Payment
4.1 The price shall be the price set out in the order for the Goods.
4.2 The Consumer Rights Act 2015 gives you certain legal rights (also known as 'statutory rights'), goods must be of satisfactory quality; fit for purpose, and Match the description, sample or model.
4.3 You place an order on the Site by completing and submitting an online medical consultation which is reviewed and assessed by an Independent Prescriber Pharmacist. The Independent Prescriber Pharmacist may then issue a prescription that is dispensed by our Responsible Pharmacist. Please read and check your order carefully before submitting it.
4.4 When you place your order at the end of the online checkout process, we will acknowledge it by email. This acknowledgement does not, however, mean that your order has been accepted.
4.5 Payment of the Price shall be due once your prescription has been approved and you have selected the relevant product you intend to purchase.
4.6 We make every effort to ensure that the pricing displayed on our website is correct. However, if an error in the pricing of a product is found we reserve the right to either cancel your order or contact you to arrange payment of any extra sum due or refund any over-payment made by you (as applicable). We reserve the right to alter all product pricing without notice.
4.7 All prices include VAT (where applicable) at the current rates. We reserve the right to express the price exclusive of VAT, but we shall show VAT separately and include it in the total price.
4.8 We accept payment with Visa and Mastercard credit and debit cards, as well as PayPal. You must pay for the products before we dispatch them. We will not charge your credit or debit card until we dispatch the products to you.
4.9 We may refuse in our discretion to accept an order: (a) where we cannot obtain authorisation for your payment; (b) if there has been a pricing or product description error; or (c) if you do not meet any eligibility criteria set out in our terms and conditions. (d) where goods ordered by you are not available; (e) if we do not deliver to your area; Where we do not accept your order but have processed your payment, we will re-credit your account with any amount deducted by us from your debit or credit card as soon as possible, but in any event within 30 days of your order. We will not be obliged to pay any additional amount as compensation for disappointment.
5 The Goods
5.1 The quality and description of the Goods shall be as set out in the Order. We have taken care to describe and show items as accurately as possible. Despite this, slight variations in items may occur. 5.2 MedsNow may from time to time make changes in the specification of the Goods which are required to comply with any applicable safety or statutory requirements, or which do not materially affect the quality or fitness for purpose of the Goods. Also, MedsNow does not warrant that the colour of the Goods will exactly match the colour shown on the website.
5.3 We will only accept your order when we email you to confirm this (Dispatch Confirmation Email). At this point:
- A legally binding contract will be in place between you and us
- We will dispatch the goods to you.
5.4 If we cannot supply certain goods, we may need to substitute them with alternative goods of equal or better standard and value. In this case, we will let you know if we intend to do this, but this may not always be possible. You can refuse to accept such substitutes; in which case we will offer you a refund or a replacement and let you know how long such an offer remains open for.
5.5 The packaging of the goods may be different from that shown on the Site.
5.6 Nothing in this Agreement affects your legal rights under the various relevant Acts.
6 Eligibility
6.1 This Site and any products sold on this Site are intended for use by persons over the age of 18.
6.2 Please note that we only provide our site for domestic and private use. You agree not to use our site for any commercial or business purposes, and we have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity.
7 Warranties and liability
7.1 MedsNow warrants that the Goods will at the time of delivery/collection correspond to the description given by the Seller (subject to the terms of clause 5.2)
7.2 Products purchased via this Site must only be used in accordance with the instructions provided with the products and/or on this Site. MedsNow accepts no responsibility for damage, loss or injury caused by improper use of the products sold. This includes liability for death or personal injury caused by our negligence or the negligence of our employees, agents or subcontractors and for fraud or fraudulent misrepresentation.
8 Cyber Security
8.1 MedsNow have incorporated a wide range of tools and processes to reduce the risk of a cyber-attack but cannot guarantee that our site will be secure or free from bugs or viruses.
8.2 You are accountable for configuring your information technology, computer programs, and platform to access our site. You should use your own virus protection software.
8.3 You must not misuse our site by knowingly introducing viruses, trojans, worms, logic bombs or other material which is malicious or technologically harmful.
8.4 You must not attempt to gain unauthorised access to our site, the server on which our site is stored, or any server, computer or database connected to our site.
8.5 By breaching this clause 11, you would commit a criminal offence under the Computer Misuse Act 1990. We will report any such breach to the relevant law enforcement authorities, and we will co-operate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use our site will cease immediately.
8.6 We will not be liable for any loss or damage caused by a distributed denial-of-service attack, viruses or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to your use of our site or to your downloading of any material posted on it, or on any site linked to it.
9. Returns
9.1 Returns will only be accepted on faulty or damaged items.
9.2 Returns of unopened, unused items may be accepted at our discretion no more than 30 days after purchase.
10. Guarantees
10.1 The guarantee is subject to the following provisions:
10.1.1 The Guarantee is only valid within the boundaries of the country of purchase.
10.1.2 The product must be correctly operated in accordance with the instructions provided with the product and within the information sections of this website.
10.1.3 The guarantee will be rendered invalid if the product is re-sold or has been damaged by an attempted repair.
10.1.4 The manufacturer disclaims any liability for incidental or consequential damages. The guarantee is in addition to and does not diminish your statutory or legal rights.
11 Delivery of Goods
11.1 We offer delivery by Special Guaranteed Delivery, Royal Mail Tracked 48 or by Tracked 24 via Royal Mail. Your order may require a signature upon delivery as it may not fit through the letterbox. If you are not available to accept an order, the standard terms of Royal Mail deliveries will apply. This will usually involve a card being left and your order is delivered to a local post office or an attempt at re-delivery. We are unable to track orders sent by standard delivery.
11.2 We process your order as soon as possible and endeavour to do this the same day when received before 2pm Monday to Friday. Orders received between 12pm Friday & midnight Sunday will be dispatched on the following Monday. On rare occasions, an item may be out of stock or unavailable and can take longer than the stated delivery time. In this case, we will attempt to contact you to inform you of delays. We are unable to give exact delivery dates except where Next Day delivery services have been purchased within the correct terms and in which case the liability will then fall with Royal Mail who provides the service.
11.3 All orders are sent via Royal Mail. Once the items have been dispatched from us, we hold no liability for damage, loss or delay. If Tracked 24 delivery has been paid for then we will put in a claim for any damage, loss or delay for you.
11.4 We accept no liability if incorrect address details are given with your order lead to loss, delay or non-delivery. Please ensure you provide the correct details when ordering.
11.5 You may contact us to request dispatch of your order at a later date and we will endeavour to meet your requirements.

11.7 If the package does not appear to be in good condition or items have been damaged, please contact us as soon as possible so that we can put in a claim with the delivery provider.
11.8 Please open all boxes or parcels as soon as they arrive, you have 7 days to notify MedsNow of any damage, shortages or incorrect items seemingly not caused by delivery. If we are not notified of damage, shortages or incorrect items within this time, you agree to indemnify MedsNow in full against any losses we suffer as a result of your failure to notify us within 7 days.
12 Acceptance of the Goods
12.1 The Buyer shall be deemed to have accepted Goods 24 hours after collection or delivery to the Buyer (unless the Buyer is a Buyer defined in condition 13)
12.2 After acceptance the Buyer shall not be entitled to reject Goods that are not in accordance with the contract.
13 Title and Risk
13.1 Title shall pass on a delivery/collection of the Goods.
13.2 Risk shall pass on delivery/collection of the Goods.
14. Remedies of the Buyer
14.1 Where the Buyer rejects any Goods (where the Buyer is entitled to reject the Goods) the Buyer shall have no further rights whatsoever in respect of the supply to the Buyer of such Goods or the failure by MedsNow to supply Goods which conform to the contract of sale.
14.2 Where the Buyer accepts or has been deemed to have accepted any Goods then MedsNow shall have no liability to the Buyer in respect of those Goods.
14.3 MedsNow shall not be liable to the Buyer for late delivery of the Goods.
14.4 MedsNow shall be under no liability whatever to the Buyer for any indirect loss and/or expense (including loss of profit) suffered by the Buyer arising out of a breach by MedsNow of this contract.
14.5 In the event of any breach of this contract by MedsNow the remedies of the Buyer shall be limited to damages. Under no circumstances shall the liability of MedsNow exceed the Price of the Goods.
15. Supply of Goods only
15.1 The Buyer acknowledges that MedsNow is simply a supplier of Goods and any application of the Goods is the sole responsibility of the Buyer.
15.2 The Consumer Protection (Distance Selling) Regulations 2000 (Regulations)
15.3 If the Buyer is a consumer within the meaning of the Regulations the following cooling-off provision applies.
15.4 Goods delivered must be cancelled in writing within 7 working days after the receipt. The Buyer will be liable to reimburse us the direct cost of recovering the goods if you cancel the order. The Buyer would then be refunded the value of the order less the direct cost of our recovering the goods. Please note the cost of recovering the goods will not exceed 20% of the gross value of your order but the exact cost will depend upon the nature of the goods and your location.
16. Proper Law of Contract
16.1 Sales on this website are governed by English law and you agree to submit any dispute to the non-exclusive jurisdiction of the English courts. All orders are subject to these terms and conditions and no amendments will be accepted by us. These terms and conditions do not affect your legal rights.
16.2 These terms and conditions only cover the MedsNow website. Any other websites to which you link from this site may be governed by their own terms and conditions. We accept no responsibility or liability for the content of websites that are not under our control.
